1. ENGINEERING DISCLAIMER

THE PQRA ENGINE IS AUTOMATED ANALYSIS SOFTWARE. IT IS NOT PROFESSIONAL ENGINEERING SERVICES. ANALYSIS REPORTS ARE GENERATED BY ALGORITHMS IMPLEMENTING PUBLISHED IEEE AND IEC STANDARDS COMPUTATIONS AND ARE PROVIDED FOR INFORMATIONAL PURPOSES ONLY.
REPORTS GENERATED BY THIS SERVICE:
(a) Are not prepared by or under the supervision of a licensed Professional Engineer (PE);
(b) Do not constitute engineering advice, engineering design, or recommendations for safety-critical systems;
(c) Should not be used as the sole basis for engineering decisions affecting electrical systems, equipment, personnel safety, or regulatory compliance;
(d) May contain errors, omissions, or inaccuracies inherent to automated analysis.
USERS ARE SOLELY RESPONSIBLE FOR VERIFYING ALL ANALYSIS RESULTS AND FOR OBTAINING APPROPRIATE PROFESSIONAL ENGINEERING REVIEW BEFORE ACTING ON ANY INFORMATION PROVIDED BY THIS SERVICE.

2. AUTOMATED ANALYSIS AND AI DISCLOSURE
2.1 Automated Processing
Analysis reports are generated by automated algorithms and AI systems. Reports are not reviewed by human engineers prior to delivery. The automated system implements computations based on published IEEE and IEC standards but may not account for all site-specific factors, installation conditions, or local electrical code requirements. Users should apply professional judgment when interpreting results.
2.2 AI-Operated Service
This Service uses artificial intelligence systems for customer support, platform monitoring, and service operations. Communications you receive may be generated or assisted by AI. You may request escalation to human review by contacting [email protected].
2.3 Standards Referenced
The Service implements computations based on the following published standards: IEEE 1159-2019 (Power Quality Monitoring), IEEE 519-2014 (Harmonic Control), IEEE 1459-2010 (Power Measurement), IEEE C57.110-2018 (Transformer Derating), IEC 61000-4-7 (Harmonics Measurement), IEC 61000-4-30 (Power Quality Measurement Methods), and ANSI C50.13. References to these standards are for identification purposes only and do not imply endorsement by the standards bodies.
3. SERVICE DESCRIPTION
3.1 Overview
The PQRA Engine is a cloud-based power quality analysis platform that processes electrical measurement data files (including MF4, COMTRADE, and CSV formats) and generates analytical reports including power quality grading, harmonic analysis, event detection, risk assessments, and economic impact projections.
3.2 Service Tiers
The Service is offered in multiple tiers (Basic, Pro, Max, and Docker/Self-Hosted), each with different features, limitations, and pricing as described on our pricing page at https://pqra.3dfs.com/pricing.
3.3 Modifications
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, including features, pricing tiers, and availability. We will provide 30 days' notice of material changes to paid tiers.
4. ACCOUNT TERMS
4.1 Eligibility
You must be at least 18 years of age and have the legal authority to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
4.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must immediately notify us at [email protected] of any unauthorized use of your account.
4.3 Accurate Information
You agree to provide accurate, current, and complete registration information and to keep this information updated.
4.4 One Account Per Entity
Each user or organization may maintain one account unless on a team plan that expressly permits multiple user accounts.
5. SUBSCRIPTION AND PAYMENT
5.1 Free Tier
The Basic (free) tier is offered at our discretion. We reserve the right to modify, limit, or discontinue the free tier at any time without notice.
5.2 Paid Subscriptions
Paid subscriptions (Pro, Max) are billed on a recurring basis (monthly or annually) as selected at the time of purchase. BY SUBSCRIBING TO A PAID PLAN, YOU AUTHORIZE RECURRING CHARGES AT THE THEN-CURRENT RATE UNTIL YOU CANCEL. This is an auto-renewal subscription.
5.3 Payment Processing
All payments are processed by Stripe, Inc. By making a purchase, you also agree to Stripe's Terms of Service (https://stripe.com/legal). We do not store your full credit card information.
5.4 Price Changes
We may change subscription prices with at least 30 days' prior notice. Price changes take effect at the start of the next billing period following the notice. Your continued use of the Service after a price change constitutes acceptance of the new price.
5.5 Taxes
All stated prices exclude applicable taxes. You are responsible for any sales tax, VAT, GST, or other taxes imposed on transactions under these Terms.
5.6 Cancellation
You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until the end of the period for which you have paid.

6. DATA AND INTELLECTUAL PROPERTY
6.1 Your Data
You retain all rights to the measurement data files you upload to the Service ("Your Data"). By uploading data, you grant us a limited, non-exclusive license to process, store, and analyze Your Data solely for the purpose of providing the Service to you.
6.2 Analysis Reports
Analysis reports generated by the Service are derivative works produced by our proprietary algorithms. You are granted a non-exclusive, non-transferable license to use, download, and distribute reports generated from Your Data for your internal business purposes. You may share reports with third parties (e.g., clients, consultants, contractors) in connection with the electrical systems from which the data was collected.
6.3 Our Intellectual Property
The PQRA Engine software, algorithms, analysis methodologies, user interface, documentation, and all associated intellectual property are and remain the exclusive property of 3DFS. Nothing in these Terms grants you any right to our source code, algorithms, or proprietary methods.
6.4 Feedback
If you provide feedback, suggestions, or ideas about the Service, you grant us an unrestricted, perpetual, irrevocable, royalty-free license to use such feedback for any purpose without obligation to you.
6.5 No Training on Your Data
We do not use your uploaded measurement files or analysis outputs to train machine learning models or AI systems.
7. DATA RETENTION AND DELETION
Data retention periods vary by tier:

After the retention period expires, or within 30 days of account deletion, your uploaded files and analysis reports will be permanently deleted. Payment records are retained for 7 years as required by financial regulations. For more information, see our Privacy Policy.
8. ACCEPTABLE USE
8.1 Prohibited Conduct
You agree not to:
(a) Upload malicious files designed to compromise the Service or its infrastructure;
(b) Use automated scripts, bots, or other tools to access the Service in bulk without written permission or an API subscription;
(c) Attempt to reverse engineer, decompile, disassemble, or probe the security of the Service;
(d) Share account credentials between organizations;
(e) Upload files containing personal data of individuals without their consent;
(f) Upload classified, government-restricted, or ITAR-controlled technical data;
(g) Upload data subject to NERC CIP regulations where disclosure would violate your regulatory obligations;
(h) Resell, white-label, or redistribute analysis reports or the Service itself without a separate commercial agreement;
(i) Use the Service to build or train a competing power quality analysis product;
(j) Use the Service for any purpose that violates applicable law.
8.2 Enforcement
We may, at our sole discretion, issue a warning, suspend, or permanently terminate your account for violations of these Terms. Egregious violations may be referred to law enforcement.
9. SERVICE AVAILABILITY
9.1 No Uptime Guarantee (Basic Tier)
The Basic (free) tier is provided "as is" with no guarantee of availability, uptime, or performance.
9.2 Paid Tier Availability
Paid tiers are subject to the Service Level Agreement published at https://pqra.3dfs.com/legal/sla. Uptime commitments, maintenance windows, and service credits are defined therein.
9.3 Maintenance
We may perform scheduled and unscheduled maintenance that temporarily affects Service availability. We will endeavor to provide advance notice of scheduled maintenance.
10. DISCLAIMER OF WARRANTIES
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.
WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT:
(a) THE SERVICE WILL MEET YOUR SPECIFIC REQUIREMENTS OR EXPECTATIONS;
(b) ANALYSIS RESULTS WILL BE ACCURATE, RELIABLE, COMPLETE, OR FREE OF ERRORS;
(c) THE SERVICE WILL BE AVAILABLE AT ALL TIMES OR THAT DEFECTS WILL BE CORRECTED;
(d) ANALYSIS REPORTS COMPLY WITH ANY PARTICULAR LOCAL, STATE, NATIONAL, OR INTERNATIONAL ELECTRICAL CODE OR REGULATION;
(e) ECONOMIC PROJECTIONS, COST ESTIMATES, OR RISK ASSESSMENTS ARE PREDICTIVE OF ACTUAL OUTCOMES.
11. LIMITATION OF LIABILITY
11.1 Cap on Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL 3DFS LLC'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE EXCEED THE AMOUNTS PAID BY YOU TO 3DFS LLC IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM. FOR FREE TIER USERS, OUR MAXIMUM AGGREGATE LIABILITY SHALL NOT EXCEED FIFTY U.S. DOLLARS ($50.00).
11.2 Exclusion of Consequential Damages
IN NO EVENT SHALL 3DFS LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, REGARDLESS OF WHETHER WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
11.3 Specific Exclusions
WITHOUT LIMITING THE ABOVE, 3DFS SHALL NOT BE LIABLE FOR:
(a) Any decisions made or actions taken based on analysis reports generated by the Service;
(b) Any damage to electrical equipment, systems, or infrastructure;
(c) Any personal injury or property damage arising from reliance on the Service;
(d) Any regulatory fines, penalties, or sanctions;
(e) Any third-party claims against you arising from your use of the Service.
11.4 Essential Purpose
THE LIMITATIONS IN THIS SECTION APPLY EVEN IF ANY LIMITED REMEDY FAILS OF ITS ESSENTIAL PURPOSE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES; IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.
12. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless 3DFS LLC and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
(a) Your use of the Service;
(b) Your violation of these Terms;
(c) Your violation of any applicable law or regulation;
(d) Any decision made or action taken based on analysis reports generated by the Service;
(e) Any claim that your uploaded data infringes the intellectual property rights of a third party.
13. DISPUTE RESOLUTION
13.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, United States, without regard to its conflicts of law principles.
13.2 Binding Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Commercial Arbitration Rules. The arbitration shall be conducted by a single arbitrator in the English language.
13.3 Class Action Waiver
YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
13.4 Small Claims Exception
Notwithstanding the above, either party may bring an individual action in small claims court for disputes within the court's jurisdictional limits.
13.5 Injunctive Relief
Nothing in this section prevents either party from seeking injunctive or other equitable relief from a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights.
14. EXPORT COMPLIANCE
This Service and its associated technical data may be subject to U.S. export control laws and regulations, including the Export Administration Regulations (EAR). You agree not to export, re-export, or transfer the Service or any data obtained through the Service in violation of applicable U.S. laws. The Service may not be accessed from or used in embargoed countries or by persons or entities on U.S. government denied parties lists.
15. GENERAL PROVISIONS
15.1 Entire Agreement
These Terms, together with the Privacy Policy, Cookie Policy, and any applicable SLA, constitute the entire agreement between you and 3DFS LLC regarding the Service.
15.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
15.3 Waiver
Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.
15.4 Assignment
You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
15.5 Notices
We may provide notices to you via email, in-app notification, or posting on the Service. Notices to us must be sent to [email protected].
15.6 Force Majeure
We shall not be liable for any delay or failure to perform resulting from causes beyond our reasonable control, including but not limited to natural disasters, wars, terrorism, epidemics, government actions, power failures, internet disturbances, or third-party infrastructure outages.
15.7 Third-Party Services
The Service integrates with third-party services (Stripe, Supabase, Vercel, Modal). Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the acts or omissions of any third-party service provider.
16. CHANGES TO THESE TERMS
We may update these Terms from time to time. Material changes will be communicated via email or prominent notice on the Service at least 30 days before they take effect. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service and cancel your account.
